Dear Working Interest Holders,
Please see attachment of the action by Oklahoma Securities Department for a
permanent injunction on both PWDR and Brian Fox. This filing clearly exemplifies
the on-going investigation by the Oklahoma Securities Department in the U.S. on
PWDR and Brian Fox. Whilst all parties concerned are trying to find ways to go
forward, no less from all Working Interest Holders, all material facts relating
to the PWDR issues must first be sought, discovered and fully disclosed. It is
prudent then that full disclosure and total accountability from PWDR and Brian
Fox must be completed before any workable or sensible proposal by any parties
can be relied on.
The hearing on the permanent injunction filed against PWDR and Brian Fox on 10th
Oct 2008 had overrun to 14th Oct 20008 and stalled again, and now adjourned to
30th Oct 2008. The court gave the adjournment based on the offer by Brian Fox
and Gerald Liew to provide for a settlement proposition for the Working Interest
investors. As of 29th October 2008, our attorneys are still awaiting the full
written proposal from Brian Fox and Gerald Liew.
To date we at OilPods, Mr. Mark Chang, and 3 of our witnesses, inclusive of the
Receiver, Mr. Bruce Day and his appointed engineer and accountant, have already
taken their stand. We are still waiting for PWDR’s CEO, Mr. Brian Fox and his
witnesses to present their evidence which should be scheduled for 30th Oct, 08.
OilPods has uploaded all current available information, including a 2 sheet
general proposition for discussion tabled by Mr. Brian Fox and Gerald Liew on
the 14th Oct 08. We believe that it was based on this general proposition that
the courts allowed for an adjournment of the hearing. The final detailed
proposition should have been ready this week for the courts and I believe for
all Working Interest holders to study the proposition. We have been advised from
our counsel that the proposition is still not ready. As we have not received any
detailed proposal from Brian Fox or Gerald Liew, we post their interim proposal
for your information. An FAQ has also been drawn up to enable all WI holders to
better comprehend all that has transpired.
